Seller Terms
These Seller Terms apply to users who apply to sell or sell artworks through Sorisomun.
Effective date: 19 July 2026
1. Scope
These Seller Terms apply in addition to the Sorisomun Terms & Conditions and other applicable policies. By applying for a Seller account, submitting a listing or completing a sale, you agree to these Seller Terms.
If these Seller Terms conflict with the general Terms & Conditions on a matter that specifically concerns Sellers, these Seller Terms take priority for that matter, unless mandatory law provides otherwise.
2. Platform operator and intermediary role
Sorisomun operates an online marketplace that enables Sellers to offer artworks to Buyers. Unless expressly stated otherwise, Sorisomun acts as an intermediary and is not the Seller, creator or owner of artworks listed by users.
The sales contract for an artwork is generally concluded between the Seller and the Buyer. The Seller remains responsible for the artwork, listing information, legal compliance, fulfilment, shipping and applicable consumer obligations.
3. Seller application and approval
A user must apply for and receive approval before publishing artworks for sale. Sorisomun may request portfolio materials, identification details, proof of ownership or authorship, business information and other supporting documents.
Seller applications are usually reviewed within 2 business days. This is an estimate and is not guaranteed.
Sorisomun may approve, reject, suspend or require additional verification of a Seller application where reasonably necessary for platform safety, fraud prevention, legal compliance or quality control.
4. Private Sellers and Professional Sellers
When applying, a Seller must accurately declare whether they act as a Private Seller or a Professional Seller.
Private Seller
A Private Seller sells only occasionally and not as part of a professional, commercial, trade or business activity.
Professional Seller
A Professional Seller sells as part of an artistic, professional, trade or business activity. A Seller may be considered professional even without a registered company, particularly where artworks are regularly created, marketed or sold for income.
Sellers must keep their status accurate and notify Sorisomun if their circumstances change. Sorisomun may review or reclassify a Seller where the available information indicates that the declared status is inaccurate.
Providing false or misleading information about Seller status may result in listing restrictions, payout holds, account suspension or termination.
5. Professional Seller obligations
Professional Sellers must comply with all consumer, e-commerce, product information, tax and business laws applicable to their sales.
This may include providing accurate business and contact information, pre-contract information, withdrawal instructions, return information, statutory remedies and other mandatory consumer disclosures.
For eligible distance contracts, a consumer purchasing from a Professional Seller may generally have a statutory right to withdraw within 14 days after delivery, subject to applicable exceptions. Professional Sellers must cooperate with valid withdrawal requests, returns and refunds.
The general statutory consumer withdrawal right normally does not apply to purchases from Private Sellers. This does not affect other rights that may apply where an artwork is damaged, not delivered, counterfeit or materially different from its description.
6. Identity and business verification
Sorisomun may require Sellers, particularly Professional Sellers, to provide and keep current information such as:
- • Legal name or registered business name
- • Residential or registered business address
- • Email address and telephone number
- • Identity document or other identity verification
- • Payment account information
- • KVK, VAT, tax identification or similar registration data
- • Evidence that the Seller is authorised to offer the artwork
Selling, listing or payout access may be restricted until required information has been provided and reasonably verified.
7. Permitted artworks
Sellers may only list artworks they own, created themselves or are otherwise legally authorised to sell.
Each artwork must:
- • Be lawful to offer and ship
- • Match Sorisomun's permitted categories
- • Be accurately attributed to its creator
- • Not infringe copyright, trademark or other third-party rights
- • Not contain a forged signature or false certificate
- • Not be counterfeit, fraudulently attributed or misrepresented
Sorisomun may remove or restrict an artwork where there are reasonable concerns about legality, authenticity, ownership, intellectual property, safety or policy compliance.
8. Listing accuracy and artwork condition
Sellers are responsible for ensuring that listing information is complete, accurate and not misleading.
Listings must accurately state, where relevant:
- • Title and creator
- • Medium and materials
- • Dimensions
- • Creation year
- • Whether the artwork is signed
- • Edition type, edition number and total edition size
- • Availability of a certificate of authenticity
- • Country of creation
- • Condition, restoration, damage and visible defects
- • Whether AI tools were materially used, where required
Photographs must reasonably represent the actual artwork. Sellers must disclose material defects or differences that could affect a Buyer's purchasing decision.
9. Pricing and platform fees
Sellers set their own artwork prices and are responsible for ensuring that prices and any required taxes are legally correct.
- • Listing an artwork is currently free
- • Sorisomun deducts a 10% Seller commission from the artwork price of a completed sale
- • Optional paid promotional services, including Spotlight, may have separate charges
- • Applicable payment, tax or other charges will be shown or documented where relevant
Sorisomun may change fees with reasonable advance notice. Changes will not normally affect transactions completed before the new fees take effect.

10. Orders and availability
A Seller must not list or sell an artwork that is unavailable, already sold or cannot be supplied as described.
After an order is confirmed, the Seller must fulfil it unless cancellation is legally required or Sorisomun authorises cancellation due to exceptional circumstances.
Repeated cancellations, failure to fulfil orders or attempts to move a transaction outside Sorisomun may result in restrictions or account action.
11. Packaging and shipping
Sellers are responsible for securely packaging and shipping sold artworks within the stated shipping deadline.
The Seller must:
- • Use packaging suitable for the artwork and delivery method
- • Protect the artwork against impact, moisture and movement
- • Follow carrier and shipping-label requirements
- • Use a valid tracking number where required
- • Ship to the address or pickup point shown in the order
- • Keep proof of shipment and appropriate packaging evidence
Sellers must not request that Buyers provide a different address outside the platform or arrange an unrecorded transaction.
12. Delivery problems, claims and disputes
Sellers must cooperate promptly and honestly when Sorisomun investigates non-delivery, loss, damage, an incorrect artwork, material description differences, authenticity concerns or intellectual-property complaints.
Sorisomun may request photographs, videos, packaging records, tracking information, certificates, ownership evidence and other relevant documents.
Depending on the circumstances, Sorisomun may facilitate or decide platform-level measures including return, replacement where possible, partial refund, full refund, payout release or payout cancellation. Mandatory legal rights remain unaffected.
13. Returns and withdrawal requests
Professional Sellers must cooperate with eligible statutory withdrawal requests and provide a usable return address and any legally required instructions.
A withdrawal notice does not automatically complete a refund. The return and refund process may require the artwork to be returned, inspected or otherwise handled according to applicable law and the Returns & Withdrawal Policy.
Sellers must not obstruct a valid statutory withdrawal or impose conditions that unlawfully limit a consumer's mandatory rights.

Seller proceeds are calculated after deduction of the applicable Seller commission and any other lawful adjustments.
Payouts may remain pending or be placed on hold where reasonably necessary, including when:
- • Delivery has not been confirmed
- • A withdrawal, return, claim or dispute is open
- • Fraud or payment reversal is suspected
- • Seller verification is incomplete
- • Required tax information has not been provided
- • A listing may violate law or platform policy
- • A payment provider places funds under review
A payout may be reduced, cancelled or recovered where a transaction is refunded, reversed, fraudulent, invalid or subject to a successful payment dispute.
Sorisomun is not a bank and does not offer a deposit or savings service. Payment processing and refunds may depend on third-party payment providers such as Stripe.
15. Taxes and VAT
Sellers are responsible for determining, registering for, charging, reporting and paying taxes applicable to their sales, including income tax and VAT where relevant.
A Seller must provide accurate tax and VAT information when requested. Sorisomun does not provide individual tax advice and does not guarantee that a Seller's tax treatment is correct.
Where Sorisomun is legally required to collect, withhold, report or remit taxes, the platform may take the steps necessary to meet those obligations.
16. DAC7 and other tax reporting
Sorisomun may be required to collect, verify, retain and report identification, tax, payment and transaction information about Sellers under DAC7 or other applicable reporting rules.
Required information may include legal name, address, date of birth, country of residence, tax identification number, VAT or company registration number, payment account details, transaction count, amounts paid and fees or taxes withheld.
Sellers must provide complete and accurate information and respond to reasonable verification requests. Sorisomun may restrict listings, sales or payouts where legally required information is missing, inaccurate or cannot be verified.
17. Intellectual property and authenticity
By listing an artwork, the Seller represents and warrants that:
- • The Seller owns the artwork or is authorised to sell it
- • Creator and attribution information is accurate
- • The artwork is not counterfeit or fraudulently signed
- • The listing and artwork do not unlawfully infringe third-party rights
- • Any edition number, certificate and provenance information is accurate
Selling a physical artwork does not automatically transfer copyright or reproduction rights to the Buyer. Any separate rights must be expressly agreed.
By uploading listing content, the Seller grants Sorisomun a non-exclusive, worldwide, royalty-free licence to host, display, resize and use that content only as reasonably necessary to operate, promote and market Sorisomun and the Seller's listings.
18. Prohibited conduct
Sellers must not:
- • Provide false, incomplete or misleading information
- • Misrepresent Private or Professional Seller status
- • Sell counterfeit, stolen or unlawfully copied works
- • Hide material damage or defects
- • Manipulate reviews, likes, views, rankings or engagement
- • Abuse claims, refunds, reports or payment systems
- • Avoid platform fees or move platform orders off-platform
- • Use another person's identity or payment information
- • Harass, threaten or discriminate against other users
- • Use Sorisomun for unlawful or fraudulent activity
19. Listing and account measures
Sorisomun may warn a Seller, request corrections, hide or remove a listing, delay publication, restrict sales, place payouts on hold, suspend features or terminate an account where reasonably necessary.
Where applicable, Sorisomun will provide the Seller with information about the reason for a restriction and any available review or appeal process, unless disclosure is prohibited or could undermine fraud prevention, security or a legal investigation.
Serious, repeated or intentional violations may result in permanent account termination and may be reported to payment providers, rights holders or competent authorities where appropriate.
20. Seller responsibility and indemnity
The Seller remains responsible for losses, claims, refunds, charges, penalties or expenses caused by the Seller's unlawful conduct, breach of these Seller Terms, inaccurate listing, intellectual property infringement or failure to fulfil an order.
Nothing in these Seller Terms excludes or limits liability where doing so would be prohibited by law.
21. Changes to these Seller Terms
Sorisomun may update these Seller Terms to reflect legal, operational, security or service changes.
Material changes will be communicated through the platform, email or another reasonable method before they take effect where required. Changes will not retroactively remove rights that have already arisen under a completed transaction.
22. Related policies
Additional Buyer Protection, fees, tax, copyright, reporting and content-moderation policies may apply when published.
23. Governing law and mandatory rights
These Seller Terms are governed by the laws of the Netherlands, subject to any mandatory laws that cannot legally be excluded.
Nothing in these Seller Terms limits any mandatory rights available to Buyers, Sellers or other users under applicable law.
