1. Overview
Sorisomun provides an online marketplace for buying and selling original artworks between independent Sellers and Buyers. By creating an account, accessing the platform or using its services, you agree to these Terms & Conditions.
2. Platform role
Sorisomun generally acts as an intermediary that enables Sellers to offer artworks to Buyers. Unless expressly stated otherwise, Sorisomun is not the Seller, creator or owner of artworks listed by users.
The sales contract for an artwork is generally concluded directly between the Seller and the Buyer. Sellers remain responsible for their listings, artworks, pricing, legal compliance, packaging, shipping, ownership rights and the accuracy of the information they provide.
3. User accounts
- • Users must create an account to access certain features
- • Buyers may browse, save and purchase artworks
- • Sellers may list and sell artworks after their Seller application has been approved
- • Users must provide complete, accurate and truthful information
- • Users are responsible for activity performed through their accounts
- • Users must keep their login credentials and account access secure
We may restrict, suspend or remove accounts that violate these Terms, applicable policies or legal requirements.
4. Seller eligibility and status
- • Sellers must offer only artworks they are authorised to sell
- • Sellers must provide accurate descriptions, photographs and artwork information
- • Sellers must accurately declare whether they act as a Private Seller or Professional Seller
- • Sellers must update Sorisomun if their selling activity or Seller status changes
- • Sellers must package and ship completed orders as described
- • Sellers may be asked to provide portfolio materials, identity information, proof of ownership or other supporting information
Seller applications are usually reviewed within 2 business days. This timeframe is an estimate and is not guaranteed.
Sorisomun may approve, reject, suspend or request further verification of a Seller application where reasonably necessary.
Additional obligations applicable to Sellers are set out in the Seller Terms.
Read the Seller Terms5. Listings
- • Listings are currently free to create
- • Sellers are responsible for all listing content
- • Listings must accurately describe the artwork, its creator, condition, materials, dimensions and relevant authenticity details
- • Material defects, damage, restoration or differences must be disclosed
- • Misleading, fraudulent, counterfeit or unlawful listings are prohibited
- • Sorisomun does not independently verify every artwork, ownership claim, copyright status or listing detail
We may request changes to, restrict, hide or remove listings that violate these Terms, platform policies or applicable law.
6. Pricing and fees
- • Sellers set their own artwork prices
- • A 10% Seller commission is deducted from the artwork price of a completed sale
- • Buyers are responsible for applicable shipping costs
- • A separate Sorisomun Care fee equal to 5% of the artwork price is charged to the Buyer and displayed before payment
- • Optional paid promotional features may have separate charges
Applicable prices, fees and shipping costs are displayed before checkout where relevant.
Sorisomun may change its fees with reasonable advance notice. Changes will not normally affect transactions completed before the new fees take effect.
7. Payments and payouts
- • Payments are processed using third-party payment providers
- • Seller payouts may remain pending until delivery, verification, returns and disputes have been handled
- • Payouts may be placed on hold or cancelled where a refund, withdrawal, payment dispute, suspected fraud or policy violation applies
- • Payment processing and payout timing may depend on third-party payment providers
Sorisomun is not responsible for delays caused solely by banks, payment providers or other third-party financial services, except where responsibility cannot legally be excluded.
8. Shipping
- • Sellers are responsible for packaging and shipping
- • Packaging must be appropriate for the artwork
- • A valid tracking number is required where applicable
- • Buyers are responsible for displayed shipping costs
- • Sellers must ship to the delivery address or pickup point shown in the order
- • Sellers should retain proof of shipment and clear packaging records
Sorisomun is not responsible for carrier delays or failures caused by third-party delivery services, except where responsibility cannot legally be excluded.
9. Delivery and issue reporting
Buyers should inspect an artwork promptly after delivery. Visible delivery problems should normally be reported within 48 hours for faster handling under Sorisomun Buyer Protection.
This platform reporting period does not remove, shorten or replace any mandatory statutory rights that apply to the Buyer.
10. Claims, disputes and refunds
Buyers may report qualifying issues such as:
- • Non-delivery or loss during shipping
- • Delivery damage
- • Receipt of the wrong artwork
- • A material difference between the artwork and its listing
- • Authenticity or intellectual-property concerns
Sorisomun may request evidence such as photographs, videos, packaging records, tracking details, certificates and communications between the parties.
Depending on the circumstances, Sorisomun may facilitate or decide platform-level measures including a return, partial refund, full refund, payout release or payout cancellation.
Platform dispute handling does not remove any mandatory legal rights available to a Buyer or Seller.
11. Sorisomun Care and Buyer Protection
Sorisomun Care is a mandatory platform fee equal to 5% of the artwork price. It supports secure payment handling, Buyer assistance and the Sorisomun Buyer Protection process.
Sorisomun Care is not insurance and does not guarantee that every claim will result in a refund. Eligibility depends on the facts, available evidence and applicable policy conditions.
The scope, exclusions and procedure of Sorisomun Buyer Protection are described in the applicable Buyer Protection Policy.
12. Consumer rights
Buyers must be informed whether an artwork is sold by a Private Seller or a Professional Seller.
Where a consumer purchases online from a Professional Seller, mandatory consumer rights may apply. These may include a statutory right to withdraw within 14 days after delivery, subject to applicable exceptions.
The general EU consumer right of withdrawal normally does not apply to a purchase from a Private Seller.
Other rights may still apply where an artwork is not delivered, damaged, counterfeit, unlawful or materially different from its description.
Nothing in these Terms limits mandatory consumer rights.
Read the Returns & Withdrawal Policy13. Seller tax and reporting responsibility
Sellers are responsible for determining and fulfilling their own tax, VAT, registration and reporting obligations related to sales made through Sorisomun.
Sorisomun may request, retain or verify information where necessary for payment processing, fraud prevention, tax reporting or other legal obligations.
Where required under DAC7 or other applicable reporting rules, Sorisomun may collect, verify, retain and report Seller identification, tax, payment and transaction information.
Selling or payout access may be restricted where legally required information has not been provided or cannot reasonably be verified.
14. Intellectual property and authenticity
Sellers must own the artwork they list or be legally authorised to sell it. Creator attribution, signatures, edition information, certificates and provenance information must be accurate.
Counterfeit works, forged signatures, false attribution, plagiarism and unlawful reproductions are prohibited.
The sale of a physical artwork does not automatically transfer copyright, reproduction, merchandising or commercial-use rights to the Buyer.
By uploading content to Sorisomun, users grant Sorisomun a non-exclusive, worldwide, royalty-free licence to host, display, resize and use that content as reasonably necessary to operate, promote and market the platform and relevant listings.
15. Identity and business verification
Sorisomun may request identity, business, payment, tax, portfolio, ownership or contact information where reasonably necessary for Seller approval, payment processing, fraud prevention, dispute handling or legal compliance.
Professional Sellers may be required to provide additional information such as a legal or business name, address, telephone number, email address, identity document, payment account, KVK number, VAT number or tax identification number.
Selling, listing or payout access may be restricted until required information has been provided and verified.
16. Prohibited activities
Users must not:
- • Sell counterfeit, stolen or unlawfully copied artworks
- • Provide false, incomplete or misleading information
- • Misrepresent Private or Professional Seller status
- • Hide material defects or damage
- • Abuse the claim, refund, report or payment systems
- • Manipulate likes, views, reviews or platform rankings
- • Attempt to avoid platform fees or move platform transactions outside Sorisomun
- • Use another person's identity or payment information
- • Upload content that infringes third-party rights
- • Use Sorisomun for illegal, fraudulent or harmful activity
17. Account restrictions and termination
Users may request account deletion, subject to the retention of information required for legal, payment, tax, security or dispute purposes.
Sorisomun may warn a user, request corrections, remove content, restrict features, hold payouts, suspend an account or terminate an account where reasonably necessary.
Serious, repeated or intentional violations may result in permanent account termination and may be reported to payment providers, rights holders or competent authorities where appropriate.
18. Liability
Sorisomun acts primarily as an intermediary between Buyers and Sellers. Sorisomun does not independently inspect or verify every artwork, listing, ownership claim, authenticity statement or copyright claim.
Sellers remain responsible for the legality, ownership, authenticity, condition and description of their artworks.
To the extent permitted by law, Sorisomun is not liable for indirect, incidental or consequential losses arising from use of the platform.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
19. Service changes and interruptions
Sorisomun may update, modify, suspend or discontinue parts of the platform where reasonably necessary for maintenance, security, legal compliance or operational reasons.
We will aim to provide reasonable notice of material changes or planned interruptions where practicable.
20. Force majeure
Sorisomun is not responsible for delays, failures or interruptions caused by events beyond its reasonable control, including carrier failures, payment-provider outages, network failures, natural events, government action or legal restrictions.
21. Relationship with other policies
These Terms should be read together with the Seller Terms, Privacy Policy, Returns & Withdrawal Policy, Buyer Protection Policy and other policies displayed on Sorisomun.
A policy that specifically governs a feature, transaction or user group may supplement these Terms for that subject.
22. Governing law
These Terms are governed by the laws of the Netherlands, subject to any mandatory laws or consumer protections that cannot legally be excluded.
23. Changes to these Terms
We may update these Terms to reflect legal, operational, security or service changes.
Material changes will be communicated through the platform, email or another reasonable method before they take effect where required.
Changes will not retroactively remove rights that have already arisen under completed transactions.
