1. Overview
This platform provides a marketplace for buying and selling original artworks between independent sellers and buyers. By using the platform, you agree to these Terms & Conditions.
2. Platform role
The platform acts only as an intermediary and is not a party to transactions between buyers and sellers. Sellers are responsible for their listings, packaging, shipping, ownership rights, and the accuracy of the information they provide.
3. User accounts
- • Users must create an account to access certain features
- • Buyers can browse and purchase artworks
- • Sellers can list and sell artworks upon approval
- • All users must provide accurate and truthful information
We reserve the right to suspend or remove accounts that violate these terms.
4. Seller eligibility
- • Sellers must offer only original artworks
- • Sellers must provide accurate descriptions and images
- • Sellers must ship items as described
- • Sellers may be asked to provide portfolio links, proof of ownership, or other supporting information
We reserve the right to approve or reject seller applications.
5. Listings
- • Listings are free to create
- • Sellers are responsible for all listing content
- • Misleading or fraudulent listings are prohibited
- • The platform does not independently verify every artwork, ownership claim, or listing detail
We may remove listings that violate platform policies.
6. Pricing & fees
- • Sellers set their own prices
- • A 20% commission is deducted from each completed sale
- • Buyers are responsible for shipping costs
- • Optional protection or support fees may apply
All fees are displayed before checkout where applicable.
7. Payments
- • Payments are processed through the platform
- • Payments may be held securely until delivery is confirmed
- • Funds are released after delivery and confirmation
The platform is not responsible for delays caused by payment providers.
8. Shipping
- • Sellers are responsible for packaging and shipping
- • A valid tracking number is required
- • Buyers are responsible for shipping costs
- • Sellers should keep clear packaging records before shipment, including internal and external packaging condition where possible
The platform is not responsible for shipping delays caused by carriers or third-party delivery services.
9. Delivery & review period
After delivery, buyers have 48 hours to review the item. If no issue is reported during this period, the transaction is considered complete.
10. Disputes & refunds
If a problem occurs:
- • Buyers must submit a claim within 48 hours after delivery
- • Evidence such as photos, videos, packaging condition, and tracking information may be required
- • The platform will review the case individually
The platform may decide on a refund, partial refund, or release of funds to the seller.
11. Sorisomun Care and protection
Buyers may add Sorisomun Care where available. Sorisomun Care may be offered as a 5% protection fee that provides extended platform support in cases of damage, loss, or disputes. Coverage is subject to review, evidence, and applicable conditions.
12. Consumer rights
The platform primarily facilitates transactions between independent users. Certain consumer protection rights, including withdrawal rights, may not apply to transactions between private individuals. Where mandatory consumer protection laws apply, these rights remain unaffected.
13. Seller tax responsibility
Sellers are responsible for determining and fulfilling their own tax obligations related to sales made through the platform. We may request or retain information where necessary to comply with legal, tax, reporting, or fraud prevention requirements.
14. Intellectual property
Sellers retain ownership of their artworks and uploaded content. By uploading content to the platform, sellers grant the platform a non-exclusive right to display, promote, and use that content as necessary to operate, market, and improve the platform.
15. Identity verification
We may request identity verification, proof of ownership, portfolio information, or additional documentation where necessary for seller approval, fraud prevention, dispute handling, payment processing, or legal compliance.
16. Prohibited activities
Users may not:
- • Sell counterfeit, copied, resold, or non-original works
- • Provide false or misleading information
- • Abuse the dispute system
- • Attempt to bypass the platform for transactions
- • Use the platform for illegal or harmful activity
- • Upload content that infringes intellectual property rights
Violations may result in account suspension, removal, or restricted access.
17. Account termination
Users may terminate their account at any time. We may suspend or terminate accounts, remove listings, or restrict access if these terms are violated.
18. Liability
The platform acts as an intermediary between buyers and sellers. We are not responsible for the quality, authenticity, legality, ownership, or condition of listed items, except where required by law.
We do not independently verify the authenticity, legality, ownership, or copyright status of every artwork listed by users.
We are not liable for indirect, incidental, or consequential damages arising from the use of the platform.
19. Force majeure
We are not responsible for delays, failures, or interruptions caused by events beyond our reasonable control, including carrier delays, payment provider issues, technical outages, natural events, or legal restrictions.
20. Governing law
These Terms are governed by the laws of the Netherlands, unless mandatory consumer protection laws provide otherwise.
21. Changes to terms
We may update these Terms & Conditions at any time. Continued use of the platform means you accept the updated terms.
