Spotlight Terms

These terms apply when a Sorisomun Seller purchases a Spotlight Listing or Spotlight Post promotional service from Sorisomun.

1. The Spotlight service

Spotlight is an optional paid promotional service supplied by Sorisomun. It gives the selected listing or Somun post additional visibility on Sorisomun for the purchased period. Spotlight does not guarantee a particular number of views, likes, enquiries or sales.

The available duration and total price are shown before payment. Current plans are 3 days for €3, 7 days for €6 and 10 days for €8. If prices change, the price shown and accepted at checkout applies to that purchase.

2. Who purchases Spotlight

Sorisomun supports both Private Sellers and approved Professional Sellers. Whether a Seller qualifies as a consumer when purchasing Spotlight depends on the legal context of that specific Spotlight purchase. A Private Seller may qualify as a consumer where the purchase is outside their trade, business, craft or profession. Mandatory consumer rights apply where that legal status is met.

If Spotlight is purchased in the course of a business, trade, craft or professional activity, statutory consumer withdrawal rules may not apply merely because the purchaser also holds a Sorisomun Seller account.

3. Payment and start of the service

Spotlight is paid in advance through Sorisomun's payment provider. The service normally starts immediately after payment is confirmed and runs continuously until the scheduled end time unless it is lawfully stopped earlier.

Before payment, Sorisomun requires the purchaser to expressly request that the Spotlight service begin immediately, before the end of any applicable 14-day withdrawal period.

4. 14-day consumer withdrawal right

Where the purchaser is legally a consumer and no exception applies, a distance service contract generally has a 14-day withdrawal period beginning when the contract is concluded. The consumer does not need to give a reason.

Sorisomun does not treat the immediate start of Spotlight as automatically eliminating the withdrawal right. If the consumer withdraws before the service has been fully performed after expressly requesting immediate performance, the consumer may be required to pay a proportionate amount for the Spotlight service already provided up to the time of withdrawal.

5. Full performance and loss of withdrawal right

A paid service contract may cease to carry the statutory withdrawal right after the service has been fully performed only where the legal conditions are met, including the consumer's prior express consent to begin performance and the consumer's acknowledgement that the withdrawal right will be lost after full performance.

Sorisomun records the immediate-performance request and acknowledgement made at checkout and confirms them in the Spotlight activation email.

6. How to withdraw online

Where a statutory withdrawal right applies, the consumer can use Sorisomun's online withdrawal function. The function identifies paid Spotlights connected to the signed-in Seller account and records the content, date and time of the withdrawal statement.

Withdraw from a Spotlight service

The consumer may also use another clear withdrawal statement where permitted by law. Using the online function is not the only lawful method.

7. Stopping the service and proportionate amount

When an eligible online withdrawal is submitted while Spotlight is active, the promotional service is stopped. Sorisomun calculates an estimated proportionate amount based on the part of the purchased Spotlight period already provided. The calculation is rounded in the consumer's favour where a cent cannot be divided exactly.

If no legally valid express request for immediate performance was recorded, Sorisomun will not rely on the proportionate-service charge merely because some Spotlight visibility was already provided. Mandatory law always takes priority.

8. Refunds after withdrawal

Sorisomun will process any refund due after a valid withdrawal using the original payment method where required, without undue delay and within the applicable statutory deadline. A recorded estimate does not reduce a refund that mandatory law requires Sorisomun to provide.

9. Payment failures, refunds and misuse

Sorisomun may refuse to start or may stop Spotlight if payment fails, is reversed or refunded, if the promoted content is removed, or if the service is used in a fraudulent or abusive manner. This does not remove mandatory consumer rights.

10. Relationship with other Sorisomun terms

These Spotlight Terms supplement the Seller Terms and general Terms & Conditions. If a provision conflicts with mandatory consumer law, the mandatory rule takes priority.
